Terms of Use

1. The service

LumaMemo is a map-centered app for personal memories, journey records, time capsules, and sharing with friends. It supports Sign in with Apple; memories containing text, photos, video, audio, dates, and locations; maps and journey replay; time- or location-based capsules; friends, shared memories, shared trips, and share cards; widgets, Live Activities, notifications, and exports; and Apple in-app purchases for subscriptions or lifetime membership.

Sync primarily uses Apple CloudKit and iCloud. Some features depend on an Apple Account, iCloud, internet access, and system permissions.

2. Eligibility

You must be at least 13. If you have not reached the age of legal adulthood where you live, use the app with guardian consent and guidance. Follow applicable laws, Apple App Store rules, these Terms, and in-app rules.

3. Accounts and security

The app primarily supports Sign in with Apple. Keep your Apple Account secure and take responsibility for activity under it. Revoked sign-in credentials, unavailable iCloud, insufficient CloudKit quota, or denied permissions may limit features.

You may delete your account in the app. This attempts to remove account-related CloudKit and local data but does not automatically cancel Apple subscriptions or remove purchase records Apple retains under its policies or legal duties.

4. Your content

You are responsible for text, photos, video, audio, locations, routes, profiles, capsules, shared content, and other content you create, upload, save, or share. You must have the necessary rights and must not infringe others’ intellectual property, privacy, image, reputation, or other lawful rights.

Do not upload, save, share, or distribute unlawful, fraudulent, infringing, or regulation-evading content; pornography, sexual exploitation, inappropriate content involving minors, or explicit sexual content; violence, threats, encouragement of self-harm, hate, harassment, bullying, or discrimination; malicious code, spam, phishing, or service-disrupting content; or others’ private, location, contact, or sensitive information without consent.

You retain rights in your content. You authorize processing only as necessary to provide and maintain the service, including storage, sync, display, compression, transcoding, thumbnails, export, sharing, revocation, and deletion.

5. Sharing, friends, and shared trips

You may add friends, send invitations, accept CloudKit shares, set memories visible to friends, and create or join shared trips. Chosen friends may see your nickname, avatar, user code, memory titles, photos, audio, location, routes, times, and viewed status. Share only with people you trust.

You can revoke sharing, remove friends, block users, or report content. Reports or safety risks may lead to hiding, limiting, deleting, revoking sharing, restricting accounts, or other necessary action.

6. Location and journey recording

Travel recording, shared trips, and location-based capsules may store precise locations, routes, stops, starting and ending points, and timestamps.

The app is not a safety, rescue, navigation, or medical service. Routes, locations, statistics, maps, and reminders are for personal records and display, not emergency response, driving decisions, or other high-risk uses.

7. Purchases, subscriptions, and membership

Subscriptions and lifetime membership are purchased through Apple in-app purchase. Apple handles pricing, taxes, trials, renewal, cancellation, and refunds under its media-service terms and App Store rules. Auto-renewable subscriptions renew through Apple unless canceled in Apple Account settings. Deleting your account or uninstalling does not cancel a subscription.

Membership may include higher creation limits, exports, capsules, shared trips, advanced maps, and personalized appearance. Actual benefits are those displayed in the app.

8. Virtual rewards and appearance items

Check-ins, tasks, coins, experience, appearance items, icons, themes, and other virtual benefits are for in-app use only. They have no cash value and cannot be sold, redeemed for cash, transferred, or used outside the app. Cheating, scripts, exploiting bugs, mass reward farming, or other abuse may result in revoked rewards, limited features, or account termination.

9. Intellectual property

The app’s software, interface, icons, copy, design, brand, code, algorithms, effects, documents, and assets are protected by intellectual property rights. Copying, modifying, reverse engineering, distributing, renting, selling, or creating derivatives without authorization is prohibited except where law expressly permits. You retain rights in your own content and must have the rights needed to use and share it.

10. Apple and third-party services

The app uses Apple services including Sign in with Apple, CloudKit, iCloud, MapKit, StoreKit, APNs, WidgetKit, ActivityKit, Speech, Photos, and LocalAuthentication. Their terms and policies may apply. We will reasonably help troubleshoot issues caused by Apple services, networks, devices, permissions, iCloud quotas, or third-party infrastructure, but cannot promise all features will always be available.

11. Changes and termination

We may update, suspend, or discontinue features for safety, compliance, maintenance, performance, or product reasons. We will seek to communicate significant changes through the app or website. Violations, infringement, abuse, or safety risks may result in restrictions, hidden or deleted content, revoked sharing, suspension, or account termination.

12. Disclaimers and liability

The app is provided as is. Except for liabilities that applicable law does not allow us to exclude, we do not guarantee uninterrupted, error-free, fully secure, fully accurate service or fitness for a particular purpose. To the maximum extent allowed by law, we are not liable for indirect, incidental, special, punitive, or consequential losses, including loss of data or profits, business interruption, or reputational harm.

13. Applicable law and disputes

These Terms are governed by the law of the location of the seller or developer listed on the App Store product page, without excluding mandatory consumer, privacy, or child-protection rights where you live. Parties should first try to resolve disputes through the contact below. Unresolved disputes may be brought before a court or consumer dispute body with lawful jurisdiction.
